Terms of Service

Your agreement when using MindSyte.

1. Agreement

By creating an account, accessing, or using MindSyte ("the Service"), you ("Customer") agree to these Terms of Service ("Terms"). If you're agreeing on behalf of a company or organization, you confirm you have authority to bind that entity to these Terms.

The Service is operated by ProtocolOne, a Canadian company based in Montréal, Quebec ("MindSyte," "we," "us," "our").

Plain English: These are the rules. By using MindSyte, you agree to follow them. If you don't agree, don't use the Service.

MindSyte is a B2B software platform for workplace safety, maintenance, and compliance management. We provide mobile and web access to features including:

You must be at least 18 years old and able to enter into a binding contract.

Account security

You are responsible for keeping your login credentials confidential. You're responsible for all activity that occurs under your account. Notify us immediately at security@mindsyte.ca if you suspect unauthorized access.

Multiple users in a company

If you sign up on behalf of a company, you may invite other authorized employees. Each employee gets their own login. You're responsible for managing user permissions within your company.

New customers receive a 14-day free trial. No credit card is required during the trial. At the end of the trial:

You retain all rights to data and content you upload to MindSyte ("Customer Data"). By using the Service, you grant us a limited license to host, process, and display your data only as necessary to provide the Service.

We aim for high availability but don't guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind.

We may perform scheduled maintenance with advance notice. We may also need to perform emergency maintenance without notice — we'll communicate as soon as possible if this happens.

To the maximum extent permitted by law:

11. Intellectual property

MindSyte, including its software, design, logo, and content (other than Customer Data), is owned by ProtocolOne and protected by copyright and other laws. You receive a limited, non-transferable, non-exclusive license to use the Service while your subscription is active.

Both parties agree to keep confidential information confidential. We will not disclose your Customer Data except as outlined in our Privacy Policy or as required by law.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be announced at least 30 days in advance via email and an in-app notice. Continued use of the Service after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to its conflict of law principles.

Any dispute will be resolved in the courts of Montréal, Quebec, unless required otherwise by applicable consumer protection law.
